Florida DUI Law 

Florida DUI laws are strict and can have serious consequences. Here are some key points:

  1. Legal Limit: The legal blood alcohol content (BAC) limit is 0.08% for drivers over 21. For commercial drivers, the limit is 0.04%, and for drivers under 21, it’s 0.02%.

  2. Penalties: Penalties for a DUI can include fines, license suspension, mandatory DUI school, community service, and possibly jail time.

    • First-time offenders may face up to 6 months in jail, while repeat offenders can face harsher penalties.

    • Typically, if you commit another crime during a DUI - like hitting someone's car and running away or breaking into a home - your punishment will be more severe. 

  3. Implied Consent Law: By driving in Florida, you automatically consent to submit to a breath, blood, or urine test if requested by law enforcement. Refusal to take a test can result in automatic license suspension. 

    • We help clients obtain their license back or obtain a hardship license which allows them to drive on the road! 

  4. DUI Checkpoints: Florida allows sobriety checkpoints where law enforcement can stop vehicles to check for impaired drivers.

  5. Felony DUI: A DUI can be classified as a felony if you have multiple convictions or if someone is injured or killed as a result.

  6. Treatment Programs: Repeat offenders may be required to complete substance abuse treatment programs.

Florida Hardship License - HOW GET BACK ON THE ROAD AFTER DUI

To obtain a hardship license in Florida after a DUI, you generally need to follow these steps

FIRST....Call us! Our dedicated team will schedule a complimentary consultation and walk you through all of your legal options. 

  1. Eligibility: Ensure you meet the eligibility requirements, which typically include:

    • Your DUI conviction must be at least 6 months old (for first-time offenders).

    • You must not have any pending DUI charges.

    • You must have completed any court-ordered DUI programs.

  2. Complete DUI School: Enroll in and complete a state-approved DUI school. You’ll need to provide proof of completion.

  3. Pay Fines and Fees: Ensure all fines, court costs, and fees associated with your DUI conviction are paid.

  4. Obtain an Evaluation: If your DUI resulted in a conviction, you may need a substance abuse evaluation. Follow any recommendations provided in the evaluation.

  5. Apply for the Hardship License: You can apply through the Florida Department of Highway Safety and Motor Vehicles (DHSMV). We will complete the process for you. 

  6. Schedule a Hearing: In some cases, you might need to attend a hearing to present your case for a hardship license.

  7. Install an Ignition Interlock Device (IID): If required, you’ll need to install an IID on your vehicle before your hardship license is issued.

  8. Follow Restrictions: Be aware of the restrictions on your hardship license, such as specific hours you can drive and where you are allowed to go.

  9. Maintain Compliance: Adhere to all terms of your hardship license, as violations can lead to further penalties.
