WHAT IS PERSONAL INJURY LAW? THE BASICS.



1. **What is Personal Injury Law?**

Personal injury law involves cases where an individual suffers harm due to someone else's negligence or intentional misconduct. The injured party (plaintiff) can seek compensation for damages such as medical expenses, lost wages, and pain and suffering.


2. **Negligence:**

In Florida, most personal injury cases are based on the legal theory of negligence. To prove negligence, the plaintiff must show:

- **Duty of Care:** The defendant owed a duty of care to the plaintiff.

- **Breach of Duty:** The defendant breached that duty through action or inaction.

- **Causation:** The breach directly caused the plaintiff’s injury.

- **Damages:** The plaintiff suffered damages as a result.


3. **Comparative Negligence:**

Florida follows a "comparative negligence" rule, which means that if the plaintiff is partially at fault for the accident, their compensation may be reduced by their percentage of fault. For example, if a plaintiff is found 20% at fault, their recovery will be reduced by 20%.


4. **Statute of Limitations:**

There’s a time limit within which you must file a personal injury lawsuit. In Florida, this is generally two to four years from the date of the injury. For medical malpractice claims, it’s typically two years from when the injury was discovered, but not more than four years from the date of the alleged malpractice.


5. **No-Fault Insurance System:**

Florida is a no-fault insurance state for automobile accidents. This means that your own insurance company will cover your medical expenses and lost wages regardless of who was at fault in the accident, up to the limits of your policy. However, if your injuries are severe and meet certain thresholds, you may be able to pursue a claim against the at-fault driver’s insurance for additional damages.


6. **Types of Damages:**

In personal injury cases, damages can be:

- **Economic Damages:** Cover tangible losses like medical bills, lost wages, and property damage.

- **Non-Economic Damages:** Cover intangible losses like pain and suffering, emotional distress, and loss of enjoyment of life.

- **Punitive Damages:** These are awarded in cases of egregious conduct to punish the defendant and deter others. They are not available in all cases and are awarded at the court’s discretion.


7. **Settlement vs. Trial:**

Many personal injury cases are settled out of court through negotiation between the parties involved. However, if a fair settlement cannot be reached, the case may go to trial where a judge or jury will decide the outcome.
